Strengthening the Protection of the Red Cross Emblem — The Ministry of Health of Ukraine Approves a New Methodology
The Red Cross emblem provides protection to medical personnel of the armed forces, religious personnel, and individuals or objects affiliated with the International Red Cross and Red Crescent Movement. Its misuse poses a threat to both the medical personnel of the Armed Forces of Ukraine and those in need of assistance in the combat zone. Unfortunately, the escalation of the war in Ukraine has led to an increase in the improper use of the emblem, necessitating stronger control in this area.
Thanks to the hard work and advocacy of the Ukrainian Red Cross, a bylaw was adopted at the end of 2024 that will significantly enhance control over the illegal use of the Red Cross emblem.
On 29 November 2024, the Ministry of Health of Ukraine approved Order No. 1985, which introduces technical amendments to the methodology for identifying medical formations and sanitary transport vehicles subject to marking with distinctive signs in accordance with international humanitarian law. According to Paragraph 11 of the methodology by the Ministry of Health of Ukraine:
“Marking sanitary transport vehicles, buildings, and structures with the distinctive emblems of the Red Cross, Red Crescent, or Red Crystal for protective purposes, without obtaining a special permit for their use, is prohibited.”
Thus, the use of the Red Cross emblem by civilian medical units and medical personnel is strictly regulated by international humanitarian law and the national legislation of Ukraine. Violation of these rules is subject to criminal liability under Articles 435, 438, and 445 of the Criminal Code of Ukraine.
